NOTICE: YOU HAVE BEEN SUED BY THE ABOVE-NAMED PLAINTIFF(S): THE COURT MAY ENTER JUDGMENT AGAINST YOU WITHOUT FURTHER NOTICE UNLESS YOU RESPOND WITHIN 21 DAYS. READ THE INFORMATION BELOW.
To the said above-named Defendants: GLENN DAMMAN; DEBORAH TRUCKEY, SCOTT FLOYD, the unknown heirs of JOHN FLOYD, and DALE FLOYD; to the unknown heirs of PEARL HAIG DAMMAN; to CAROLYN HAIRE, JEAN PASCHKE, and JOAN HAUGLIE; and also to all other persons or parties claiming any right, title, estate, lien, or interest in the real estate described in the Complaint filed with the clerk of said court.
You are hereby notified that in order to defend this lawsuit, an appropriate written response must be filed with the above designated court at PO Box 126, Twin Falls, ID 83303, (208) 736-4085 within 21 days after service of this Summons on you. If you fail to so respond the court may enter judgment against you as demanded by the plaintiff(s) in the Complaint. A letter to the Judge is not an appropriate written response
The nature of this suit is a complaint to quiet title, more specifically to declare that the Plaintiff is the fee simple owner of the below described real property located in Twin Falls County, Idaho, and holds title free from any lien or claim in favor of the named defendants or any other person who may claim title or interest to the real property at issue:
Parcel 1: Assessor’s Parcel RP09S14E147200, to wit two (2) acres in the Northeast corner of the Northeast Quarter of the Southeast Quarter (NE¼SE ¼) of Section 14, Twp. 9 South, Range 14, AND
Parcel 2: Assessor’s Parcel RP10S19E325400, to wit eighty (80) acres, the West Half (W ½) of the Southwest Quarter (SW ¼) of Section 32, Tp. 10 South, Range 19.
A copy of the Complaint is served with this Summons. If you wish to seek counsel or representation by an attorney in this matter, do so promptly so that your written response, if any, may be filed in time and your legal rights protected. An appropriate written response requires compliance with Rule 10(a)(1) and other Idaho Rules of Civil Procedure and must also include:
- The title and number of this case.
- If your response is an Answer to the Complaint, it must contain admissions or denials of the separate allegations of the Complaint and other defenses you may claim.
- Your signature, mailing address and telephone number, or the signature, mailing address and telephone number of your attorney.
- Proof of mailing or delivery of a copy of your response to plaintiff ‘s attorney, as designated above.
