NOTICE OF PUBLIC HEARING AND LETTING
NOTICE OF PUBLIC HEARING ON PROPOSED DRAWINGS AND SPECIFICATIONS PROPOSED FORM OF CONTRACT AND ESTIMATE OF COST FOR THE CONSTRUCTION OF WASTEWATER TREATMENT FACILITY MCC REPLACEMENT FOR, THE CITY OF SANBORN, IOWA, AND TAKING OF BIDS THEREFORE.
Notice is hereby given that the City Council of the City of Sanborn, in O’Brien County, Iowa, will meet at City Hall in said City, on the 10th day of April , 2023, at 5 o’clock P.M., at which time and place a hearing will be held on the proposed plans and specifications, form of contract and estimate of cost for the Wastewater Treatment Facility MCC Replacement (the “Project”) in said City.
At the said hearing, the City Council will consider the plans and specifications, proposed form of contract and the estimate of cost for the Project, the same now being on file in the office of the City Administrator, reference to which is made for a more detailed and complete description of the proposed work, and at the said time and place, the City Council will also receive and consider any objection to said plans, specifications and form of contract or cost of the project made by any interested party.
Sealed proposals will be received by the City Administrator of Sanborn, Iowa, at City Hall until
11:00 o’clock A.M., on the 6 day of April , 2023, for the Project, as described in the Contract Documents therefor, now on file in the office of the City Administrator. Proposals will be opened and read at a meeting to be held City Hall, Sanborn, Iowa, on the hour and the day above specified, and may be acted on at such later time and place as may be then fixed.
The work is generally described as follows:
Replacement of the motor control center (MCC) located in the Operations Building, along with HVAC improvements to the building. The project will include electrical, programming, HVAC, and miscellaneous appurtenant work.
The City will receive and consider bids on the entire project, will enter into a single contract for the proposed construction and will award the contract to the lowest responsive, responsible Bidder.
All work is to be done in strict compliance with the Contract Documents, which have heretofore been approved by the City Council, and are now on file for public examination in the office of the City Administrator.
Each proposal shall be accompanied by a certified or cashier’s check drawn on a solvent Iowa bank, or a bank chartered under the laws of the United States, or by a share draft drawn on an Iowa credit union or a credit union chartered under the laws of the United States, made payable to the Treasurer of the City of Sanborn, Iowa. Checks shall be in the amount of ten percent (10%) of the amount of the bid. In lieu of a certified or cashier’s check, each proposal may be accompanied by a bid bond, issued by a company authorized to contract as surety in Iowa. Bid bonds shall be in the amount of ten percent (10%) of the amount of the bid. If a bid bond is used it should be in substantially the same form as the bid bond form set out in the Contract Documents.
Payment to the Contractor for said improvements will be made from such cash funds of said City as may be legally used for such purposes.
The Contractor will be paid ninety five percent (95%) of the Engineer’s estimate of the value of acceptable work completed at the end of the preceding month. The final payment will be made no earlier than thirty-one (31) days after completion of the work and acceptance by the City provided all final documents, including waiver and release of liens, have been furnished and executed by the Contractor.
Final payment will not be due until the Contractor has certified to the City that the materials, labor, and services have been paid for in accordance with the requirements stated in the Contract Documents.
This improvement is being constructed pursuant to authority granted the City of Sanborn by Chapter 384 of the Code of Iowa.
The successful Bidder will be required to furnish Performance and Payment Bonds each in an amount equal to one hundred percent (100%) of the contract price, said bonds to be issued by a responsible surety approved by the City, and shall guarantee the faithful performance of the contract and the terms and conditions therein contained and shall guarantee the prompt payment of all material and labor and protect and save harmless the City of Sanborn from claims and damages of any kind caused by the operations of the Contractor and shall also guarantee the maintenance of all improvements in good repair for a period of one (1) year from and after the completion and acceptance by the City of Sanborn, Iowa.

All proposals shall be filed on the forms furnished by the City of Sanborn, sealed and plainly marked. Any alteration of the proposal form may be cause for rejection of the proposal.
The City of Sanborn hereby reserves the right to reject any or all bids, to waive informalities and to enter into a contract with the lowest responsive, responsible Bidder.

By virtue of statutory authority, preference will be given to products and provisions grown and coal produced within the State of Iowa and to Iowa domestic labor to the extent lawfully required under Iowa statutes; provided, however, that the Board may award such Contract as it deems to be in the best interests of the City, which shall be without regard to such factors. The Owner will, in evaluating Bids, consider the requirements of the resident bidder preference law, and allow such preferences to resident bidders as are required to be allowed under State Law. Bidder shall, when submitting a Bid, furnish an executed Bidder Status Form for the Owner to use when applying the preference law. Failure to submit a fully completed Bidder Status Form with the bid may result in the bid being deemed nonresponsive and rejected.
The successful Bidder shall be required to meet Federal requirements outlined in the bid documents, award documents, construction documents, supplemental conditions, and other contract forms.
Out-of-state contractors (as defined by Section 103A.3 of the current Iowa Code), before commencing a contract in excess of $5,000 in value in Iowa, shall file a bond with the office of the Division of Labor Services of the Department of Employment Services in accordance with Section 91C.7 of the current Code of Iowa.
It is understood that the Work to be done is being financed with funds from the Iowa State Revolving Fund (SRF). As such, the work will be subject to Davis-Bacon and related ACT Requirements, Federal Labor Standard Provisions and American Iron and Steel requirements. All Contractors, including subcontractors, shall be registered with the State of Iowa. The Work will not be Awarded to any Contractor not registered with the State of Iowa, or any Contractor on the Debarred or Suspended lists.
